These terms of service ("terms") form the agreement between you and recappin about your use of recappin, a social network and club management platform for sport. Please read them carefully. How we handle your personal data is explained in our privacy policy. You are asked to read it, but it is information for you, not part of this agreement.

1. Who we are

Recappin is operated by recappin, [street and number, postal code, city, country], registered under [trade register and number, e.g. Chamber of Commerce (KvK) number], VAT number [VAT identification number]. You can reach us at [contact email address]. This address is also our single point of contact for users and for authorities under the EU Digital Services Act; you can write to us in English, Dutch or German.

2. Accepting these terms

By creating an account you accept these terms. You can only use recappin after accepting the current version of these terms and confirming that you have read the current privacy policy. We record which versions you accepted and read, and when.

3. Who can use recappin

4. Your account

5. The service

Recappin lets you create a profile, connect with others, post, send messages, manage organizations and their members, keep an agenda, track your training and, if you choose, use dating. The service is currently free of charge. We develop recappin continuously and may add, change or remove features. If a change significantly limits how you can use recappin, we will tell you in good time, unless the change is required by law or for security reasons.

We do our best to keep recappin available and secure, but we cannot guarantee that it will always be available without interruption or errors. Keep your own copy of anything that is important to you; you can export your data at any time.

Recappin is currently in beta: we are still testing it. During the beta, features may change or disappear, and data you store in recappin may be lost or reset without notice. Take this into account and keep your own copy of anything that is important to you.

6. Your content

You own your content. Everything you post, upload or send (text, photos, messages, agenda items and so on) remains yours.

Licence to us. To be able to run the service, you give us a non-exclusive, royalty-free, worldwide licence to store, copy, process, resize and display your content, only to the extent needed to provide recappin to you and to the audience you choose. This licence ends when you delete the content or your account, except for copies we must keep by law or for the reasons explained in the privacy policy (for example evidence attached to a report, or backups until they expire).

Your responsibility. You may only post content that you have the right to share. If your content shows other people, make sure they agree, especially if they are minors. You are responsible for your content and must not infringe anyone else's rights.

7. Rules of conduct

You may not use recappin to post, send or do anything that:

8. Organizations

If you create or manage an organization, you are responsible for how you use it: for who you admit, invite and remove, for the roles and permissions you hand out, and for what is posted on the organization's behalf. Only invite people who expect to hear from you, and respect your members' privacy. If your organization records members' personal data in recappin for its own purposes, it must comply with data protection law for that use. Assigning a supervised minor to a division requires the guardian's consent.

Organizations moderate their own division conversations: division leads and members with the right permission can delete messages there. Such a deletion is a decision of the organization, not a measure taken by us. If you think content in a division conversation breaks the law or these terms, you can report it to us.

9. Health, training and events

Training zones, heart rate estimates, goals and other figures in recappin are for information only. They are not medical advice. Consult a doctor before starting an intensive training programme, especially if you have health problems.

Events in the agenda are organised by users and organizations, not by us. We are not a party to any arrangement between hosts and participants. Prices shown on an event are for information only; you cannot pay through recappin. You take part in events at your own risk.

10. Dating

Dating is opt-in and only for adults who are single. Be honest on your dating card. Be careful when sharing personal details or meeting people you have not met before: meet in a public place, tell someone you trust where you are going, and report anyone who behaves inappropriately. We do not check the identity or background of users and cannot guarantee anyone's intentions.

11. Reporting content and how we moderate

Reporting. You can report a profile, profile photo or background image, post, image, message, dating card, agenda item or organization page using the report button. If you are not a user, or if you want to report illegal content, send a notice to [contact email address] with: where the content can be found (a link if possible), why you believe it is illegal, your name and email address (unless you are reporting child sexual abuse material), and a statement that your notice is accurate and complete in good faith. We confirm receipt and inform you of our decision. We may ask you for more information about your report. In recappin you can follow the status of your reports, and withdraw a report as long as it has not been decided.

What we do. Every report is assessed by a person. When a moderator removes content, bans an account or suspends an organization, the other open reports about that same content, account or organization, and repeated reports of the same thing by the same person within a short period, are closed together with that decision; their reporters are informed of the outcome and told that their report was closed together with that decision. Apart from that, one automated check applies: every file you upload is checked before it is stored, for malicious software and, once that check is switched on, for photos also against known child sexual abuse material (see the privacy policy). A file that fails is refused. If a photo matches known child sexual abuse material, we suspend the account at once, a member of our staff then reviews the case, and we report it to the competent authorities where the law requires it; you can appeal the suspension. We use no other automated means to detect or assess content. If content or behaviour breaks the law or these terms, we may: remove the content, suspend the account for a set period (with or without removing content), ban the account permanently, or suspend an organization, for a set period or until we lift it. We choose a measure that is proportionate to the seriousness, the number of violations and the harm caused. If we come across information suggesting that someone's life or safety is at risk, we inform the relevant authorities.

Statement of reasons. If we take a measure against you, we tell you what we did, which content or behaviour it concerns, which rule of these terms or which law we relied on, how long a suspension lasts, and how and until when you can appeal. We never tell you who reported you. While your account is suspended or banned, your profile and posts are hidden from others; messages you already sent remain visible to the people you sent them to. If we suspend an organization, the statement of reasons goes to its administrators and stays available on the organization's management page. While an organization is suspended, it is hidden from search and discovery and is read-only; its members can still leave it.

Appeals. You can appeal a measure we took against you, or our decision on a report you filed, once, within six months, also after a suspension has already ended, by explaining why you disagree. Your appeal is handled by a member of our staff who was not involved in the original decision, not by an automated system. You will receive a reasoned decision. If your appeal against a measure succeeds, we reverse the measure; if your appeal against our decision on your report succeeds, we review your report again. If you sent your notice by email, we send our decision by email, and you can object to it in the same way by replying to that email. If we suspend an organization, its administrators are told why, which rule or law we relied on, and until when they can object. Any one of them can object on the organization's behalf, once per suspension, within six months, also after the suspension has ended, from the organization's management page. A member of our staff who was not involved and is not a member of the organization reviews the objection and gives a reasoned decision; if it succeeds, we reverse the suspension and, if it is still in force, lift it. You may also go to a certified out-of-court dispute settlement body under Article 21 of the Digital Services Act, or to court.

Misuse. We act against misuse of recappin under Article 23 of the Digital Services Act. Content is manifestly illegal when anyone can see without legal analysis that it is illegal, such as a threat of violence or child sexual abuse material. A report or an objection is manifestly unfounded when anyone can see without investigation that nothing is wrong, such as reporting someone's ordinary posts again and again out of spite. A moderator looks at each case and weighs how many such items or reports there were in the past six months, what share they are of everything you posted or reported in that time, how serious the misuse is and what its consequences are, and, where it can be established, whether it was intentional. We always warn you first. If the misuse continues within 12 months of the warning, we may suspend your account for a set period, or stop handling your reports and your objections to our decisions on them for 7, 30 or 90 days; reports you filed before that are still handled, and you can always appeal a measure taken against you. Every warning and suspension comes with a statement of reasons and can be appealed as described above. This does not stop us from taking a measure straight away when a single violation is serious enough on its own, as described under "What we do".

12. Content from others and links

Users are responsible for their own content; apart from the automatic check of uploaded files described in section 11, we do not check content before it is published. Only suggestions for the interest and sports catalog and proposed new organization types are reviewed by our staff before others can see them. Embedded videos and audio from YouTube, Vimeo and Spotify are provided by those services under their own terms. We are not responsible for websites or services outside recappin that users link to.

13. Ending the agreement

You can stop using recappin at any time and have your account erased. We may suspend or end your account as described in section 11 if you seriously or repeatedly break these terms or the law, if we are required to by law, or if your account endangers other users or the service. We may also end the service as a whole, with at least 60 days' notice, so you have time to export your data. Sections that by their nature should continue to apply after the agreement ends (such as sections 6, 14 and 16) remain in force.

14. Liability

We provide recappin with care, but free of charge and as it is. To the extent permitted by law, we are not liable for indirect damage, lost profits or lost data, or for damage caused by other users or by services of third parties. Our total liability towards you is limited to the amount of €100.

These limitations do not apply to damage caused intentionally or by gross negligence, to injury to life, body or health, to the breach of essential obligations without which the agreement cannot be properly performed (in that case our liability is limited to the foreseeable damage typical for this kind of agreement), or where the law does not allow liability to be limited, and they do not affect your rights as a consumer.

15. Changes to these terms

We may change these terms, for example because of new features or new laws. We will inform you at least 30 days before a change takes effect, unless the change is required by law or for security reasons. You will be asked to accept the new version before you can continue using recappin. If you do not agree, you can stop using recappin and have your account erased on the data request page, which works without accepting the new version.

16. Applicable law and disputes

These terms are governed by the law of the country where recappin is established. If you are a consumer living in the European Union, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country. Please contact us first at [contact email address]; we will try to resolve your complaint with you. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

17. Other provisions

If any provision of these terms is invalid, the rest remains in force, and the statutory rules apply in place of the invalid provision. If we do not enforce a provision straight away, we do not waive our right to do so later. These terms are available in English, Dutch and German; in case of a difference, the version in the language you use recappin in applies.
